LIMITED WARRANTY- Gia Quartz

Gia Stone LLC. warrants to the owner of the original installation that Gia Stone LLC. , shall be free from material defects (Quartz) for 10 years from the initial installation. This LIMITED warranty is issued to the original owner of the commercial property or structure into which product was originally installed and expires upon transfer of the ownership to a third party. This is the only product warranty made by Gia Stone LLC. No representative, dealer or any other person is authorized to make or make any warranty, representation or promise on behalf of Gia Stone LLC. with respect to such products. No terms or conditions other than those stated herein, and no agreement or understanding, oral or written, in any way purporting to modify this warranty shall be binding upon Gia Stone LLC. unless made in writing and signed by an authorized senior manager of Gia Stone LLC. Stone slabs sold by Gia Stone LLC shall be thoroughly inspected before fabrication. If in the case that the color, material, and pattern ends up not being what the user wanted, Gia Stone LLC is not responsible as this is not a defect and is not covered by warranty. Material defects do not include using improper cleaning materials on the stone. It is the sole responsibility of the fabricator and installer to determine that the material is inspected before cutting- to determine color variances, defects, lot number, matching patterns, etc. that would impact the project as Gia Stone LLC is not responsible for project plans nor does Gia Stone LLC get involved in specific project plans and is only responsible for supplying material based on what is ordered. 

Gia Stone LLC. makes no express or implied warranty including without limitation, the warranties of merchantability, fitness for a particular purpose, or from any other course of dealing or trade usage regarding the product. No warranty whatsoever is made in regards to materials produced or provided by other manufacturers. 

This warranty applies to the repair or replacement of defective quartz slab that has been permanently installed and has remained in its original location. However, mistakes or change of preference is not warranted by Gia Stone LLC, we only cover defects as assessed by the Gia Stone LLC team. Gia Stone LLC.’s sole responsibility and liability under this warranty shall be to repair, or to replace, at Gia Stone LLC's sole option, the products shown to be defective, during the warranty period. Following installation, you must register with Gia Stone LLC. within thirty (30) days in order to activate your warranty. In the event that no record of your warranty registration is on file, you must provide proof of purchase in the form of your original receipt or invoice showing the name of the Owner and Certified Gia Stone LLC installer. Upon receipt of this original documentation, Gia Stone LLC. will fully honor this warranty.

In order for Gia Stone LLC. to respond under this warranty, the owner must give Gia Stone LLC. notice within 30 days of any alleged defects that appear or should have been discovered after the exercise of reasonable diligence. You must also provide proof of warranty registration within 30 days after installation. In the event that no record of your warranty is on file, you must provide proof of purchase in the form of your original receipt or invoice showing the name of the Owner and Certified Gia Stone LLC. installer. Gia Stone LLC. or Gia Stone LLC.’s authorized agents must be permitted to inspect the product and thereafter to follow Gia Stone LLC.’s warranty services procedures. All decisions regarding the existence of manufacturing defects or affecting this warranty shall be made by Gia Stone LLC. and shall be final and binding upon the parties. 

In the event of defects covered under this warranty, Gia Stone LLC. shall have the sole discretion whether to repair or replace quartz material (not including the cost of installation and/or fabrication). Without derogating from the aforementioned, replacement of defective quartz slab will be subject to inventory constraints. In addition, the replaced slab may not be exactly the same as the defective slab. 

Gia Stone LLC. shall have no liability for any loss, expense or damage, arising out of or in connection with the installation and/or fabrication of Gia Stone LLC. products. Subject to applicable laws, Gia Stone LLC. shall not be liable either in contract or tort for indirect, incidental, punitive, consequential, special or any other similar damages, including but not limited to, loss of business profits, business interruption or any other loss whether or not caused by or resulting from the negligence of Gia Stone LLC. Gia Stone LLC is not liable for misuse of the slabs, mishandling during and/or before and/or after transportation. Gia Stone LLC is also not responsible for slabs stored incorrectly therefore resulting in deformities and/or defects due to incorrect handling and storage. 

This warranty applies to products that have been maintained according to Gia Stone LLC. maintenance and care guidelines. In addition, Gia Stone LLC. shall not be responsible for any damage or injury caused in whole or in part by acts of God, climate, job site conditions, architectural and engineering design, structural movement, acts of vandalism, accident, war, nor defective or improper workmanship by the installer or any laborer, nor any other damage or injury not solely and directly caused by defects in products covered by this warranty. 

Each party assumes all risk and liability for results obtained by the use of quartz products covered by this warranty, whether used alone or in combination with other materials. No warranty whatsoever is made with respect to the materials produced by other manufacturers. Laws and building and safety codes governing the design, engineering and construction of installations vary widely. Gia Stone LLC. assumes no responsibility or obligations with respect to the selection of product for the installation or the design, engineering and construction of the installation.

THE FOLLOWING ARE NOT COVERED UNDER THE LIMITED WARRANTY: 

1. Damage caused by mishandling, misuse, damage from excessive heat or uneven exposure to weather conditions, physical or chemical abuse, or uses of products exposed to outside weather and climate conditions. 

2. Routine maintenance and minor conditions such as surface stains and water spots that may be corrected by following the techniques specified in the Gia Stone LLC. Care & Maintenance guide are not covered. 

3. Gia Stone LLC. products used in outdoor or flooring applications.

4. Damages caused by improper installation or installation with a known or visible manufacturing defect at the time of installation, including, but not limited to, color variance particularly at seam locations. 

5. Excessive impact damage, chips and surfaces scratches to the quartz product. Gia Stone LLC. surface product is an extremely durable material and is scratch resistant but not scratch proof. 

6. Seam performance or seam appearance, adhesives, caulks or any other accessory items. 

7. Any modification or alteration of the quartz product including bending or curving, milling, reduction in thickness or factory applied finish. 

8. Natural variations in color, size, shape or distribution of the pattern of the natural quartz or the natural variations in background tone. Spots or “beauty marks” smaller than a ten-cent (10) piece. A certain level of spots or ‘beauty marks” are inherent in the manufacturing process and do not affect the structural integrity of the product. These characteristics are inherent and unique characteristics of the product. Color samples provided to architects, designers, dealers, homebuilders, consumers and fabricators are only representative and not an exact replication of what will be installed. Color samples do not directly replicate the color as a whole and are only a sample piece cut from a specific slab from a specific lot. Color variance is natural and occurs often. If color variance is not acceptable for a specific project, it is up to the fabricator/installer to inspect the quartz and make this known before cutting the quartz.

9. Any additional work such as plumbing, electrical, tile, cabinets, flooring, etc. that may need to be done as a result for a repair or replacement of a defective quartz slab covered under this warranty. 

10. Damages caused by work such as plumbing, electrical, tile, cabinets, flooring etc. 

11. Quartz product that has been moved from its original installation location. 12. Unoccupied commercial property or structures. 

13. Quartz products and/or services that have not been paid in full. 

14. The end user changed their mind on what stone they wanted and/or thinking they chose a different slab when they were provided with the corresponding photo(s) and/or corresponding sample(s).

15. Any slabs damaged during transport under the responsibility of anyone who is not directly employed by Gia Stone LLC. Gia Stone LLC therefore is not responsible for the slabs once a fabricator or contractor has the slabs under their care or on their own form of transport.

THE FOREGOING IS THE COMPLETE WARRANTY FOR GIA STONE LLC. PRODUCTS AND SUPERSEDES ALL OTHER WARRANTIES AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN EXCEPT AS EXPRESSLY SET FORTH ABOVE. NO OTHER WARRANTIES ARE MADE WITH RESPECT TO GIA STONE LLC. AND GIA STONE LLC. EXPRESSLY DISCLAIMS ALL WARRANTIES

NOT STATED HEREIN, INCLUDING, TO THE EXTENT PERMITTED BY APPLICABLE LAW ANY WARRANTY THAT MAY EXIST UNDER NATIONAL, STATE, PROVINCIAL OR LOCAL LAW INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY HAVE OTHERS.
